Bringing an Adopted Child to Canada: Brief Guide

Canada allows its permanent residents to bring their adopted child to Canada and also grants them Canadian citizenship. However, there are conditions that must be met by a person in order to immigrate their adopted child to Canada. It includes:

  • Age requirement: The person sponsoring an adopted child must have attained the age of 18 years
  • Residency requirement: He/she must be living in Canada
  • Status requirement: He/she must be a permanent resident of Canada or Canadian national. In case the sponsor is outside Canada temporarily, then he/she must come back and reside in Canada at the time when they are sponsoring the child.

Bring A Child Into Canada: A Two-Step Process

Bringing an adopted child to Canada is a two-step process. Firstly, the adoption process needs to be finalized. While the second step begins with the sponsoring of the child and concludes with the grant of Citizenship Certificate. It is essential note that a person who has a criminal record or penalized, has no intention of residing in Canada at the time of sponsoring of the adopted child, failure of compliance of the court’s order, etc.

Adopting The Child

A child can be adopted by a Canadian national either outside Canada or within Canada. If a person adopts outside from Canada, then it is pertinent for a person to keep in his/her mind that adoption must be legal in that country from where the child is being adopted. Another crucial aspect of adoption is that it ends the legal relationship of the child with his/her natural parents.

Sponsoring an adopted child means committing to provide for that child and maintain a child-parent relationship with him/her throughout their lives. Therefore, it is also required under Canadian law that the adoption truly establishes a child-parent relationship, is in the best interests of the child, and the adoption is not motivated by reasons of acquiring a permanent residence for the adopted child. Lastly, a home-study is also conducted by your provincial adoption authority in case of an adoption outside from Canada.

Sponsoring The Adopted Child

Once you are done with the adoption step, you can file to sponsor your adopted child. After completing the sponsorship application with all the necessary documents, you can submit the application for it to be processed. Application needs to be filed online. Make sure to gather all necessary documents, including

the proof of adoption, the child’s identity documents, and evidence that the adoption meets Canadian legal requirements. After submission, the application will be reviewed by IRCC. This process may include background checks, interviews, and verification of documents.

After the sponsorship application is approved, the child will receive a visa to enter Canada. Once in Canada, the child can receive their Citizenship Certificate, making them a Canadian citizen.
